as to your question, it's yet to be properly thought through as far as I can see but I think it's going to come down to some notion of value when you don't win. So stickers/kinder eggs etc, you get something even if its not the toy you wanted. Some loot boxes, you get nothing.

It's inevitable that this is going to be regulated at some point once Govt gets its head around the issue (although given the importance of the gaming industry to our economy, perhaps not until it becomes a social media/political issue)
