Yes it should have been sorted at the time to avoid this. They probably thought

he wouldn't get out and no-one would have any issues with it. Bit of a mess and IPPs are no longer made although life sentences are of course which are pretty much the same thing.

In my opinion it is appropriate to consider unconvicted behaviour at parole hearings for IPPs because we are not talking about sentencing- the grey area was in a way deliberately thrown at the sentencing stage.
