whether or not a player makes contact with an opponent is often down to the opponent's agility (or otherwise) in getting out of the way. Why should a two players making exactly the same challenge suffer different penalties based on what somebody ELSE does? In a similar vein, throwing a punch should be a red card offence regardless of whether you actually make contact or not.
