the difference in the situations is..

the FA couldn't have given us a UEFA place because their rules of precedence for qualification for England's 2 93/4 UEFA places were clearly stated as:
1) League Cup winner
2) 2nd place in league.
We only got in despite coming 3rd as a bonus because no-one qualified via the League Cup (Arse would have done if Wed had won the FA Cup).

However there is no FA rule that says they had to give 4th place in Prem (Everton) precedence over CL winners (in fact their own website last year pronounced that CL winners would have precedence in that situation). FA did have the right in their own rules to give Liverpool one of their 4 places and chose not to in the hope of getting a 5th place.
