Let's be clear on this. He is not appealing his conviction. The court of appeal have

already ruled that out: "We can see no possible basis which would justify us to interfere with the verdict of the jury which heard all the evidence and reflected on it following a careful summing up by the judge."

The Criminal Cases Review Commission are examining the case to see if new evidence provided by a private defective means that the decision to deny him right to appeal should be overturned. If they agree, then he can appeal.

In fact many questions have been asked as to why the CCRC have fast-tracked the Evans case, given that they already have a backlog of hundreds of other possible miscarriages of justice that his case has leap-frogged in front of. People that are still in jail.
