I'd prob go for asking him to sort it before you paid the balance. If he refuses you can mention taking legal advice and taking him to the small claims court.... If you go for the full refund option straight away then you may find the process takes much longer, and you'd still be stuck with a s**t floor. I'd give the guy a chance to fix it and use words like "taken expert opinion" and "disappointed" rather than demand the money back....
