If no details are taken by the seller it can't. But...

the cell from which you call or send messages is always recorded. Plus, you phone is unique and has a unique I.D :)

Indeed. Handset has an IMEI but we'd only know it if sim locked to us

Oh and SIM's are recorded so if it's sold by a flybe and he takes no details then
