it is perfectly reasonable

to argue that insulting language ought not to be criminal. Not everything that is unpleasant or immoral is also a crime. In this context, part of the difficulty lies in deciding where to draw the line between lawful and criminal, deciding which features or characteristics warrant this protection; what the effect ought to have been on a "victim" (in this case, the words were not evern heard); the intention/mental state with which they were spoken; and so on and so on.
