Nobody's suggested it's a mere description

it's very obviously an insult (subject to what is intended); but the issue is whether there is such a difference between a comment such as "you black bastard" and and one such as "you f****** northern c*** I hope you die of cancer" (for pleasant example) that one should be a crime, punishable by the state, and the other not.
