I think it grew up as a shorthand for an alleged rape where the victim knows the offender

and was voluntarily with him on a social occasion

Apart from the difficulties of proof, that type of case is the one where you can sometimes get blurred issues of consent (eg she consents to begin with but then changes her mind while they're at it and he won't stop - that's still rape, but it usually gets sentenced more leniently)
