There is no risk really. Only slightly to his reputation.

He could prove he wasnt driving, its not his job to prove who was driving.

Without his testimony the crown prosecution have nothing.

He could actually be telling the truth? ;-)

He might not know who was driving? ;-)

There is a small chance he has fallen out with his mates over this because they wouldn't say who was driving. :-D .... :-D ..... :-D ........ :-D
