suspended term of 2 years.

he has no previous and was in his own house where the thief shouldnt have been. Jailing him would be harsh as he didn't go out and think "I'm going to batter someone today"

suspended sentence means if he is actually a nutter and beats someone else up then they can bang him away, but if he's not and it was a one off confronting an intruder he doe not have to waste his life in jail
