they have a suitably short notice period you can use, a convenient break clause, or a termination provision that is operative.

Otherwise it's a fecking expensive claim for wrongly sacking them.

Sadly I don't suppose Cureton has a 'the employee shall at all times be capable of hitting a cow's backside with a banjo' type clause that we could get him on.
