The refs error. Gave him a decision to make, sure. But VAR is supposed to cut this out.
If Kabak had really caught him at the pace the guy was going and the way Kabak swung the guy would not be walking freely, the slap would leave the ref in no doubt about the contact and he would have some serious bruising. As it was the guy was clearly already leaving his feet and Kabak aborted the swing.
No pen.
