PM; Azteca - Parking Charge...

I was only in the car park 10 minutes, and never got out of the car (Mrs Worthing Yellow had to pick something up) and I'd never used the car park before.

I had £100 'charge' which is basically an invitation to pay and therefore create a contract... I declined to pay.

Appealed through parking company first on two fronts; (a) no valid contract as the signage wasn't legible from within a vehicle nor on entering the car park so I couldn't reasonably been aware of the terms; (b) unreasonable charge for such a short period.... they turned it down.

Appealed through POPLA purely in the no valid contract formed argument and told them I had photographic evidence of signage, butI never submitted any photos.

Appeal upheld, happy days!

Took from 1st March until now though, but worth the wait and the effort.

No guarantee it will work for others as all circumstances are different, but shows it's possible to take them on and win.
