In this case, the provisions of the RTIA haven't been complied with by the prosecuting authority in that the NIP came after 3 or so months meaning that Squiz cannot be 100% sure who was driving and there is no photographic evidence which can make this identification possible.
As a general principle, you're correct. But it's not black and white in this case.
