How do you clarify the rule?

I think the benefit of the doubt should be with the fielder in that scenario.

He had it sufficiently under control to send it up in the air.

I think it is distinguishable from your other examples.

It's not totally clear cut, I agree, but you have to draw the line somewhere and for me, that is on the out side of the line.
