He'll have to show that he's mitigated his loss - ie tried to find alternative employment instead of sitting on his arse. If he doesn't, any damages he wins will be reduced.

So he could take our job whilst still pursuing Cardiff for the difference between what we pay him and what he would have been receiving from Cardiff (assuming they'd have been paying him more).
