The law applies equally to everyone

I think the point that Simon Nicholls was making is that the law allows for non disqualification of an individual who can demonstrate extreme hardship. The legal definition of extreme hardship is not subjective like everyone thinks but subjective i.e. not being employed as one test.

All speeding is after all is a form of taxation.
