Any legal types around ?
Some new people have moved into a house at the far end our garden. They are doing some building (all planned) and have pulled the end fence down and are rebuilding it, currently sinking some new fence-posts.
They have informed us that our greenhouse and base in on their hand by a few inches (between 3 and 6 but no more) and yesterday they asked us to move it. They have offered to help, we have not responded yet.
Some background
We moved into our house March 2000.
It is their boundary and fence to repair.
The land at the end of the garden was sold by one of the old owners of our house in 1967 and the same man lived in the house at the end of the garden from 1967 (when the land was built on) until his death last year. The boundary has never been in dispute.
We think the greenhouse has been there since around 1995, and could not have been built into the land as the fence was there, which we have always assumed was the boundary. The fence is very old, and Mrs KC painted back in 2001 which upset the old man as some of the paint dripped through the slats and spoiled his side ? we helped him repaint it for him.
Anyone know where we would stand on this? I don?t want to move the greenhouse as it would mean a bundle of work on a Saturday (meaning less City games!) and probably cost.
I?m thinking that the fence has always been there, very slightly out of position that this is the ?new assumed? boundary? Is this correct?
I think he'll be reasonable and relent but in case not it would be good to know what the law may or may not be.
