Depends who has the other address.

Do they do something similar to you? Could people get confused and buy from the owner of the .com instead?

And do you want your brand associated with theirs? Some people may mistake your business as a brand extension of theirs. So you get tainted by what they do. Like even if enron.com still exists, setting up an enron.co.uk would be a brave (foolhardy!) marketing choice!
