Its an interesting issue, and one that pulls me a few ways.

I agree, the background of the kid involved is utterly irrelevant to any reasonable person. That's not the issue at all.

I do feel that when a person illegally enters another persons house, with the intent to further break the law or cause harm, then their legal rights have been waived.
No protection, no right to sue.

However, there does need to be a limit on the response of the householder, and if its proved their response was excessive, they should face charges for that.
However, I'm not sure it should ever by higher than Manslaughter, becuase i'd argue its hard for it to be that premeditated if you've woken up in the night and found someone in your bedroom.

The biggest arguement against a blanket right of force would be the sit-yoo-ashuns that happen in the states.
Kids sneak out at night, or come back late, parents hear a noise, get up and attack. ITs not till the shot is fired they realise the figure infront of them is their own kid.
